Siêu Việt Group (SVG) hereby informs users of its policy regarding the collection and use of personal data. To effectively provide our services, Siêu Việt Group shall collect and process certain user personal data through its website and mobile applications (the “Platform”). Siêu Việt Group is committed to protecting your data and ensuring its privacy and security in compliance with all applicable laws. By accepting this Privacy Policy upon account registration, you grant us permission to collect, use, disclose, and/or process your personal data as outlined herein. This consent remains effective from the date of your acceptance until you withdraw it or it is automatically terminated in accordance with the law. If you do not consent to this data processing, please refrain from using our services or Platform.

The Platform may contain links to third-party websites or applications that are beyond our control. Siêu Việt Group, as the owner and operator of the Platform, disclaims all responsibility for the privacy policies and practices of these third parties. We therefore recommend that you review their privacy policies to understand your rights and obligations concerning your data.

I. Collected Personal Data

The Platform collects personal data in various ways, consistent with the purpose of providing services to you and based on your voluntary submission. This collection is conducted in compliance with Vietnam’s Labor Code, Law on Employment, and Decree No. 13/2023/ND-CP in order to comply with the data control and process. The collected information may include, in whole or in part:

1. Full name, including middle and birth names.

2. Date of birth.

3. Gender.

4. Residential information, including permanent and temporary addresses.

5. Nationality.

6. Personal image.

7. Contact numbers, identification numbers, and passport numbers.

8. Marital status.

9. Family relationship information (e.g., parents, children).

10. Email address.

11. Educational and work history, including references.

12. Payment details, such as bank account and credit card numbers.

13. Account information, including user ID, password, account usage history, and details of purchased products or services.

14. Technical data, such as IP address, browser type, location, and device information.

15. Real-time and precise location data of your device while using the Platform.

16. Any other data or files you actively provide or upload to the Platform.

Sensitive personal data may also be collected, including:

17. Your voice from recorded calls.

18. Health status from medical reports and criminal history reports you provide.

19. Income level.

20. Ethnicity, religion, and political party affiliation.

If you link your Platform account with a social media account, you authorize us to access and process the data you have provided to the social media provider. We will manage this data in accordance with this Privacy Policy.

If you provide us with third-party personal data, you confirm that you have obtained the necessary consent for us to collect, store, use, and/or process that data. You must provide us with legal documentation to prove such consent.

II. Purposes for Data Collection, Use, and Disclosure

Depending on your relationship with us, the data we collect may be used for the following (incomplete) purposes:

1. Identity verification and online account management.

2. Providing services related to job searching and recruitment. This may include publicly displaying your data on the Platform and transferring it to third-party employers.

3. To process any order (s) you submit through the Platform (including any payments you make through the Platform for products, whether sold by us or any of our affiliates).

4. Verifying and implementing any key financial transactions conducted online involving payments, and to identify you for anti-money laundering, suspicious transaction reporting and fraud detection purposes;

5. Communicating with you to address inquiries, feedback, and complaints, whether directly or through any outsourced customer service provider;

6. Notifying you about new products and services from the Platform or its partners.

7. Sending you promotional materials from us or from our offices or partners, or to ask for your opinion on current products and services or potential new products and services.

8. Improving the Platform and its products and services.

9. Conducting market research on user demographics and behavior.

10. Providing you with information we believe may be useful or which you have requested from us, including information about our products and services or those of our affiliates, provided you have not expressed your objection to being contacted for such purposes.

11. Complying with court orders, legal processes, or government regulatory requirements.

12. Any other purpose disclosed at the time of data collection. (Herein after referred to as "Purposes")

III. Use of Cookies

The Platform uses cookies to store and track information to provide personalized services. Cookies are small data files sent to your browser from a web server and stored on your computer’s hard drive. Some features require you to accept cookies to function. (Please see “Your Choices” for more details on Cookie).

Cookies are generally used for:

(1) Identifying new job listings since your last visit.

(2) Storing your login credentials for convenience.

(3) Enabling you to save job listings for later review.

Third-party advertising networks on the Platform may also use their own cookies.

The Platform may collect information about your usage, such as visited areas and accessed services, as well as hardware and software data, including your IP address and browser type.

IV. Data Processing

Your data will be stored and processed, in whole or in part, in Vietnam. By accessing the Platform from outside Vietnam, you consent to the transfer of your data to Vietnam. Your personal data may be transferred, stored, or processed abroad for the stated Purposes, in compliance with personal data protection laws.

By providing your information, you agree that Siêu Việt Group, its affiliates, subsidiaries, and other corporate entities may use your data in accordance with the stated Purposes and legal regulations.

We may use your contact information to send you updates about the Platform. You have the option to receive promotional materials and newsletters from us. The content and frequency of our communications will vary based on the information we have about you. You have the right to choose whether to receive information, notifications, and promotions, including free newsletters from the platform that relate to topics you might find interesting.

When you choose to make your personal data public on the Platform, you authorize Siêu Việt Group to share it on the Platform and related channels. However, other users, such as employers, may also collect this information. In such cases, separate agreements for data collection are required between you and these third parties, and Siêu Việt Group, as an intermediary, is not liable for their actions.

V. Data Sharing

We do not disclose your personal or sensitive data to third parties, except in the following circumstances:

  1. With your explicit consent. For example, we may provide your contact information to third parties if you wish to receive information about their recruitment or services. We may use your data to determine your interest in a third party’s products or services.
    We may send job seekers’ data to employers during the recruitment process, at the direction of both the job seeker and the employer. This data is processed according to both our Privacy Policy and the employer’s own policies.
  2. We may share your data with companies and individuals we hire to perform corporate functions on our behalf, such as data analysis or payment processing. These parties are authorized to access your data only as necessary to perform their functions and may not share it with other third parties.
  3. We may disclose such information if required by law, or by a government agency, or if we believe that such action is necessary to: (a) Comply with public law; (b) Protect the rights or property of Sieu Viet Group, or its partner companies; (c) Prevent a crime or protect national security; or (d) Protect the personal safety of users or the public.
  4. We may disclose and transfer your information on the Platform to a third party who acquires all or substantially all of the business of Sieu Viet Group, whether by merger, consolidation, or purchase of all or substantially all of our assets. Additionally, in the event Sieu Viet Group becomes the subject of a bankruptcy proceeding, whether voluntary or involuntary, Sieu Viet Group or its trustee may sell, license, or otherwise dispose of such information in a transaction approved by the bankruptcy court.
  5. We may use your name, your company name or logo, or other information about or from your job postings or candidate profile viewing accounts for any and all subsequent purposes of Sieu Viet Group (or the Platform). For example, company names or logos may be used in newspaper advertising, direct mail, sales collateral, posters, and other materials related to the Platform or other Sieu Viet Group properties.
    Sieu Viet Group and the Platform may also share de-identified information about visitors to one of its Websites (for example, the number of visitors to the Platform's 'Find a Job' section) with its clients, partners and other third parties so that they may understand the kinds of visitors to the Platform’s websites and how those visitors use the site.
    Sieu Viet Group may provide technology, web hosting and other related services to other leading companies to set up recruitment sections on websites other than ours (sometimes called “recruitment areas” or by such other name as Sieu Viet Group will notify you before applying). Personal information provided by you in recruitment areas becomes part of the Platform database, but is not accessible to anyone other than you, Sieu Viet Group and the relevant company without your consent.
    Information collected on a recruitment area page, or on a co-branded page (such as a contest page co-sponsored by the Platform and another company) may become the property of that company, or of both Siêu Việt Group and that company. In this instance, the other company’s use of such information may depend on the agreement between you and that company and, in any event, Siêu Việt Group is not responsible for the other company’s use of your personal data.

VI. Your Rights and Choices

If you choose not to register or provide personal information, you will be unable to use most of the Platform’s services.

You also have choices regarding cookies. By changing your browser preferences, you can choose to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies, you will not be able to use Platform services that require registration. These services include identifying new jobs that have been posted since your last visit, auto-login, and the job listing feature. You can still use most of the Platform’s features even if you do not accept cookies.

VII. How to adjust and delete your information?

We shall provide you with the means to ensure that your personal information is accurate and up to date. You have the right to modify or delete your personal information at any time by:

  1. Logging in and editing or deleting your profile on the Platform.
  2. Calling our hotline at (028) 7107 6666 for assistance.
  3. Submitting a request through the Platform. Sieu Viet Group will check the information and contact the User to confirm the information and edit/delete the Customer information when the information has been fully and accurately verified.

If you forget your password, you can use the “Forgot password?” feature to receive it via email. Account deletion is possible but will remove access to login-required features. We may retain an archived copy of your account.

VIII. Risks and Safeguards

Remember that any personal information you voluntarily disclose on the internet can be collected and used by others beyond our control.

Other than the Platform Administrator or other authorized Platform personnel, you are the ONLY person who has access to your personal information. Your registration is password-protected to prevent unauthorized access.

Ultimately, you are solely responsible for maintaining the confidentiality of your password and/or any account information. Please be careful and responsible in your online activities. We recommend that you do not disclose your password to anyone. The Platform will never ask for your password over the phone or in an unsolicited email. For your own safety, you may log off the network once you have finished using the Platform. This ensures that others cannot access your personal information and correspondence if you share a computer with someone else or use a computer in a public place such as a library or internet café.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, while we strive to protect your personal information in accordance with the law by implementing all necessary technical and legal measures, the Platform cannot ensure or warrant the security of any information you transmit to us or from our online services, and you do so at your own risk. Once we receive your information, we will do our best to ensure its security on our systems.

IX. Protection of Minors

You are required to provide your age. Children must obtain parental or guardian consent before submitting personal data online. The Platform does not knowingly collect or share personal information from users under 13 years of age. Additionally, the Platform will not send any direct emails asking users to indicate they are under 13 years of age.

X. Withdrawal of Consent

You may withdraw your consent to the use, disclosure, storage, or processing of your personal data at any time by contacting our hotline at (028) 7107 6666. We will respond to your request promptly.

Please note that if you withdraw your consent to our use, disclosure, storage and/or processing of your personal data for the Purposes as set out above, we may not be able to continue to provide services to you or perform any of the terms of our contract with you, and we will not be liable in the event that we do not continue to provide services to, or perform our contract with, you. In such an event, our legal rights and remedies will obviously remain.

XI. Policy Amendments

We reserve the right to amend this Privacy Policy at any time, provided such changes do not violate current law. All users will be notified of these changes on the Platform.

XIII. Dispute Resolution

You may file a complaint regarding this Policy with Siêu Việt Group at any time using the provided contact information.

Any dispute/violation related to personal data arising during the use of the Platform shall be resolved in accordance with the law in effect on the date of the dispute of the Socialist Republic of Vietnam.

If the above-mentioned dispute/violation is not resolved by negotiation within sixty (60) days from the date one Party notifies the other Party in writing of the dispute, one of the Parties (including you and Sieu Viet Group or a third party) has the right to bring the case to a competent court in Ho Chi Minh City for settlement in accordance with the law.
